Overview
Welcome to Brush & Bloom. The terms “we,” “us,” and “our” refer to Brush & Bloom. Brush & Bloom operates this website, store, and related information, content, features, tools, products, and services (collectively, the “Services”). The Services are powered by Shopify.
These Terms of Service, together with the policies referenced here, describe the rights and responsibilities that apply when a customer visits, uses, or purchases through the Services.
By accessing or using the Services or completing a purchase, you agree to these Terms, our Privacy Policy, Refund Policy, and Digital Delivery Policy. If you do not agree, do not use the Services or complete a transaction.
Eligibility and Account Responsibility
You represent that you are at least the age of majority in your jurisdiction or have valid permission from a parent or legal guardian. You must provide current, accurate, and complete information.
You are responsible for protecting your account credentials, email account, devices, browser sessions, and payment methods. You are responsible for activity completed through resources you knowingly permit another person to use.
Products and Product Descriptions
Brush & Bloom provides digital educational and creative materials, including acrylic-painting notes, project packs, reference images, color and supply lists, step-by-step instructions, add-ons, upgrades, and related content.
We make reasonable efforts to describe products accurately, but colors, layout, pagination, formatting, scale, and appearance may vary by device, browser, display, software, printer, paper, ink, art supplies, and settings. We may revise, improve, replace, or discontinue products and may limit availability to any person, region, or jurisdiction.
Orders and Acceptance
Submitting an order is an offer to purchase. An order is accepted when payment is approved and Brush & Bloom confirms or provides the purchased access. We may reject or cancel an order for suspected fraud, pricing or technical errors, product unavailability, policy violations, or other legitimate reasons.
Customers must review all products, add-ons, prices, fees, and totals before submitting an order. Selecting a clearly labeled purchase or upgrade button constitutes affirmative authorization for the displayed transaction.
Prices, Fees, and Billing
Prices, discounts, and promotions may change without notice. The price governing a transaction is the price displayed and accepted when the order is placed. Taxes and an applicable Digital Processing Fee may be added where displayed before payment.
You represent that you are authorized to use the selected payment method and agree to pay the displayed total. A processing fee associated with a digital order is a one-time charge, not a subscription.
Free Materials
Brush & Bloom may offer certain digital materials at no product price, including the 1,000+ Free Acrylic Painting Notes offer. A processing fee or separately selected paid add-on may still apply when clearly displayed before acceptance.
Receiving a free product does not automatically include every optional painting pack, premium upgrade, or future product.
Optional $1.29 Painting Packs and Add-Ons
Painting project packs and other add-ons may be offered separately at $1.29 USD each. Every selected add-on is a separate one-time digital purchase and is not automatically included with the primary product.
Customers may decline an add-on and retain their original materials. Selecting a clearly labeled button identifying the product and its $1.29 price affirmatively authorizes the additional purchase.
Delivered $1.29 painting packs and other digital add-ons are final sale under the Refund Policy.
Optional $59.99 Premium Digital Upgrade
Certain offers include an optional one-time premium digital upgrade priced at $59.99 USD. The upgrade provides additional or enhanced materials beyond the original purchase and is charged separately.
Customers may decline the upgrade and retain their original purchase. Selecting a clearly labeled button identifying the upgrade and its $59.99 price affirmatively authorizes the additional purchase.
The $59.99 upgrade is not a subscription or recurring charge. It is final sale after digital delivery under the Refund Policy.
No Automatic Subscription
Purchasing notes, a painting pack, another add-on, or an upgrade does not create a subscription. Brush & Bloom will not impose recurring charges unless a separate offer expressly identifies a subscription and discloses its price, billing frequency, renewal terms, and cancellation method before the customer affirmatively enrolls.
Digital Delivery
Unless expressly stated otherwise, products are delivered digitally and no physical item is shipped. Access may be provided by email, confirmation page, download link, customer account, or another disclosed digital method.
Customers are responsible for accurate contact information, compatible equipment and software, and personal backup copies of downloadable files. Additional delivery terms appear in the Digital Delivery Policy.
Final Sale and Refunds
Digital purchases are final and non-refundable after delivery, access, download, unlocking, or availability, except for the limited remedies in the Refund Policy or rights that cannot legally be waived.
Mistaken selection, failure to read an offer, change of mind, nonuse, dissatisfaction with artistic style or presentation, repeat purchase, or failure to achieve a desired result does not create voluntary refund eligibility.
Educational and Creative Purpose
Brush & Bloom materials are general educational and creative resources. They are not accredited coursework, professional certification, individualized art instruction, business advice, legal advice, medical advice, or a guarantee of any particular artistic or commercial outcome.
Users are responsible for selecting suitable art materials, following manufacturer safety instructions, supervising minors, protecting surfaces and clothing, and using paints, solvents, tools, and equipment safely in an appropriate environment.
No Results Guarantee
Brush & Bloom does not guarantee artistic skill, identical finished artwork, sales, income, social-media engagement, competition results, professional opportunities, or any specific educational, creative, personal, or commercial result.
Individual results depend on experience, effort, materials, equipment, interpretation, and other factors outside Brush & Bloom’s control.
Personal-Use License
Subject to payment and compliance with these Terms, Brush & Bloom grants the purchaser a limited, personal, non-exclusive, non-transferable, revocable license to use purchased materials for the purchaser’s own individual, non-commercial learning and creative practice.
No ownership or intellectual-property rights are transferred. Unless written permission expressly states otherwise, customers may not share account access or files; reproduce, upload, publish, distribute, resell, sublicense, teach or sell the materials as their own course; create substantially derivative instructional products; or use the content to train a commercial artificial-intelligence system.
Customer Artwork
Customers retain rights in their own original creative contributions. Brush & Bloom’s rights in its instructions, reference materials, photographs, layouts, and other protected content remain unchanged. Reproducing a Brush & Bloom project for personal practice does not grant permission to redistribute or resell the instructional materials.
Intellectual Property
The Services and Brush & Bloom materials—including text, photographs, illustrations, reference images, demonstrations, layouts, graphics, downloads, product names, branding, and their selection and arrangement—are owned by Brush & Bloom or its licensors and protected by intellectual-property laws.
Unauthorized copying or distribution may result in termination of access and enforcement of available rights and remedies.
Prohibited Uses
You may not use the Services to violate law or third-party rights; distribute malware; interfere with security; scrape or harvest information without permission; impersonate another person; submit false payment disputes; engage in fraud; or exploit the Services or materials beyond the license granted.
Third-Party Services and Links
The Services may link to or use third-party platforms, payment providers, applications, and websites. Brush & Bloom is not responsible for third-party content, availability, privacy, security, products, or practices. Use of third-party services is governed by their terms.
Relationship with Shopify
Shopify provides the commerce platform that enables the Services. Purchases are made directly from Brush & Bloom, not Shopify. To the extent permitted by law, Shopify is not responsible for Brush & Bloom products, transactions, representations, or customer support.
Disclaimer of Warranties
To the fullest extent permitted by law, the Services and products are provided “as is” and “as available.” Brush & Bloom disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that content will be error-free, complete, current, uninterrupted, or suitable for every user, device, artistic medium, or purpose.
Limitation of Liability
To the fullest extent permitted by law, Brush & Bloom and its owners, affiliates, service providers, licensors, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, profits, opportunities, or goodwill; property damage from art activities; or decisions based on educational content.
To the fullest extent permitted by law, total liability arising from a product or transaction will not exceed the amount actually paid to Brush & Bloom for the specific product giving rise to the claim.
Indemnification
To the extent permitted by law, you agree to indemnify and hold Brush & Bloom and its owners, affiliates, service providers, and representatives harmless from claims, losses, and reasonable costs arising from your unlawful use, unauthorized distribution, violation of these Terms, or infringement of another person’s rights.
Termination
We may suspend or terminate access for fraud, abusive disputes, unauthorized sharing or distribution, security threats, or material violation of these Terms. Termination for misuse does not create refund eligibility.
Severability and Waiver
If a provision is invalid or unenforceable, it will be limited only to the minimum extent necessary, and the remaining provisions will continue in effect. Failure to enforce a provision does not waive the right to enforce it later.
Entire Agreement
These Terms, the policies incorporated by reference, product descriptions, checkout disclosures, and order summary form the entire agreement concerning the Services and purchases. Informal communications do not modify this agreement unless an authorized Brush & Bloom representative expressly agrees in writing.
Changes
We may update these Terms for operational, legal, security, or regulatory reasons. The version displayed when a purchase is completed will generally govern that purchase.
