Digital Products and Final Sale
Brush & Bloom sells digitally delivered educational materials, acrylic-painting notes, project packs, reference materials, downloads, add-ons, upgrades, and related content. No physical product is shipped unless a product page expressly states otherwise.
Except for the limited remedies expressly stated below or a right that cannot legally be waived, every digital purchase is final, non-cancellable, non-returnable, non-exchangeable, and non-refundable once the product has been delivered, emailed, unlocked, displayed, accessed, downloaded, or otherwise made available.
Digital delivery is completed when a download link, product file, access page, account entitlement, or access instructions are sent to the email address supplied at checkout or displayed on an order-confirmation page.
Failure to open, download, save, print, read, view, use, or benefit from a successfully delivered product does not create refund eligibility. Customers should retain personal backup copies where downloads are available.
Purchase Acceptance and Button Selections
By clicking, tapping, or otherwise selecting a clearly labeled purchase, payment, add-on, or upgrade button, the customer confirms that they reviewed the identified product, displayed price, applicable fees, and complete order total and affirmatively authorizes the transaction.
A mistaken, rushed, unintended, or accidental selection made by the customer does not by itself make a transaction fraudulent or unauthorized when the product, price, and purchase action were clearly displayed.
Customers are responsible for reviewing their order before submitting it. Purchasing the same product, pack, add-on, or upgrade more than once does not create voluntary refund eligibility.
Optional $1.29 Painting Packs and Add-Ons
Certain offers include optional digital painting packs or other add-ons priced at $1.29 USD each. Every selected pack is a separate, optional, one-time purchase and is not automatically included with the original product.
Customers may decline these add-ons and retain their original materials. Selecting a clearly labeled button identifying an add-on and its $1.29 price constitutes affirmative authorization to purchase it.
Each $1.29 digital painting pack or add-on is final and non-refundable after digital delivery. Accidental selection, failure to read the offer, change of mind, nonuse, or purchasing the same pack more than once does not create voluntary refund eligibility when the offer and price were clearly displayed.
Optional $59.99 Premium Digital Upgrade
Certain offers include an optional premium digital upgrade providing additional or enhanced materials beyond the original purchase. This upgrade is a separate, optional, one-time purchase of $59.99 USD. It is not a subscription or recurring charge.
The $59.99 upgrade price is additional to the original order. Purchasing the upgrade does not cancel, replace, reduce, credit, reimburse, or refund the original purchase unless the upgrade offer expressly states otherwise.
Customers may decline the upgrade and retain their original purchase. Selecting a clearly labeled button identifying the upgrade and its $59.99 price constitutes affirmative authorization to purchase it.
The optional $59.99 upgrade is final and non-refundable once the upgraded materials have been delivered, unlocked, accessed, downloaded, displayed, or otherwise made available. Accidentally selecting the upgrade, failing to read the offer, changing one’s mind, or later deciding the upgrade is unnecessary does not create voluntary refund eligibility when the offer and price were clearly displayed.
No Automatic Subscription
Purchasing Brush & Bloom notes, a $1.29 painting pack, another add-on, or the $59.99 upgrade does not create a subscription unless an offer expressly identifies itself as a subscription and separately discloses its price, billing frequency, renewal terms, and cancellation method before the customer agrees.
No recurring charge is created by a one-time digital purchase. Any future optional subscription will require a separate affirmative selection and acceptance of the subscription terms.
Digital Processing Fee
An applicable Digital Processing Fee may be charged to support secure digital fulfillment, file hosting, delivery infrastructure, platform maintenance, fraud prevention, and customer access assistance. The applicable fee and complete order total are displayed before payment is completed.
The Digital Processing Fee is a one-time order charge, not a subscription. It becomes final and non-refundable when the associated digital products are delivered or made accessible, except where a different result is required by applicable law or binding payment-network rules.
Exclusive Limited Remedies
Defective or Corrupted File
If a purchased file is corrupted, cannot be opened in its advertised format, or is materially different from the product description, Brush & Bloom will first attempt to resolve the issue by providing a new link, corrected or replacement file, format guidance, or reasonable technical assistance.
Replacement, corrected delivery, or restored access is the primary voluntary remedy. A refund may be considered only if Brush & Bloom cannot provide a functioning version within a reasonable period.
Failure to Receive Access
If access instructions or a download link are not received, the customer must contact Brush & Bloom so the order can be verified and access restored. Resending the product, correcting the delivery email, replacing the link, or restoring account access is the primary voluntary remedy.
A refund may be considered only if Brush & Bloom cannot provide access after verifying the order.
Verified Third-Party Fraud or Technical Billing Error
A transaction may be reviewed when credible evidence indicates genuine third-party fraud, account compromise, or a technical billing error that caused the amount charged to differ from the amount clearly displayed and accepted.
The customer’s own click, tap, button selection, failure to read an offer, mistaken selection, or change of mind is not a technical billing error or third-party fraud when the product, price, and purchase action were clearly displayed.
Customer Account, Device, and Payment Responsibility
Customers are responsible for securing their email accounts, store accounts, payment methods, devices, browser sessions, passwords, and saved payment information.
Customers are responsible for purchases made by another person whom they knowingly permit to use their account, device, browser session, or payment method. Permitting a family member, household member, colleague, or another person to use these resources does not automatically make a resulting purchase unauthorized.
Strict Request Deadline
A request under an expressly stated limited remedy must be submitted within two calendar days of purchase, unless a longer period is required by applicable law.
Email support@learning-notes.com with the customer’s full name, order number, checkout email address, proof of purchase, a complete explanation, relevant screenshots or error messages, and any additional information reasonably requested to investigate the issue.
Submitting a request does not guarantee approval. Incomplete, unsupported, misleading, or untimely requests may be denied.
Non-Refundable Situations
Except where a different result is required, refunds, credits, cancellations, and exchanges are not provided for:
- Change of mind or buyer’s remorse;
- Accidentally selecting a clearly labeled purchase, add-on, or upgrade button;
- Purchasing the same product, pack, add-on, or upgrade more than once;
- Purchasing the wrong product or version;
- Failure to read a description, price, fee, order summary, or button;
- Failure to use, access, download, save, print, view, or practice with a delivered product;
- Providing an incorrect email address or failing to check spam, junk, or promotions folders;
- Deleting, losing, or misplacing a downloaded file;
- Lack of compatible software, storage, internet access, printing equipment, art materials, or technical knowledge;
- Preference for a different artistic style, design, layout, color, font, organization, teaching style, or presentation;
- Failure to achieve a desired artistic, educational, commercial, or personal result;
- Finding similar information elsewhere or later deciding the material is unnecessary;
- A change in personal or financial circumstances; or
- Sharing, copying, redistributing, uploading, publishing, reselling, or otherwise misusing a digital product.
Chargebacks and Payment Disputes
Please contact Brush & Bloom before initiating a payment dispute so the issue can be investigated. Brush & Bloom may respond with applicable offer disclosures, displayed pricing, purchase records, order confirmations, delivery records, access or download records, account and device information where lawfully collected, the policy in effect at purchase, and customer communications.
Fraudulent, knowingly false, or abusive disputes may result in suspension of access and may be contested through the applicable payment provider. Nothing in this section prevents a customer from exercising a payment-dispute right that cannot legally be waived.
Final Voluntary Refund Decision
Brush & Bloom’s written determination is final for voluntary refund, replacement, credit, exchange, or accommodation requests submitted directly to the business. An exception made for one transaction does not require the same exception for another transaction.
If a refund is approved, it will ordinarily be returned to the original payment method. Access to refunded products may be disabled, and the customer must delete downloaded copies and stop using or distributing the refunded materials.
Final and Complete Agreement
This policy, together with the applicable product or upgrade description, checkout disclosures, order summary, and Terms of Service, is the complete agreement regarding returns, refunds, exchanges, credits, cancellations, digital delivery, upgrades, add-ons, and processing fees.
No informal customer-service conversation, social-media message, advertising comment, or oral statement changes this policy. Any modification must be written and expressly approved by an authorized Brush & Bloom representative.
If any provision is invalid or unenforceable, it will be limited only to the minimum extent necessary, and the remaining provisions will continue in effect.
Rights That Cannot Be Waived
Nothing in this policy excludes a right or remedy that applicable law or binding payment-network rules prohibit a business or consumer from waiving. If a non-waivable requirement conflicts with this policy, only the conflicting provision will be limited to the minimum extent required.
